Abstract
The paper aims to touch on the issue of shariah compliance governance in the application of taqarruq at the current financial institutions. This is due to the fact that this instrument is one of the most significant Sharia’ based contracts that had increased the creative aspects of contemporary financial products and instruments based on its basic model. The Malaysian Commodity Market is chosen as a case study as it is seen as initiating a pioneering effort in applying contemporary tawarruq according to certain systems, regulations, instructions and procedures that must be adhered to ensure its compliance with the Shariah – as intended by its regulators. Subsequently, the application of tawarruq in that market will be analysed according to the necessary Shariah standards in order to explain the prevalence of Shariah compliance governance in that market and in order to identify the Shariah related issues regarding the matter as well as finding the proper solutions to address these issues.
