<p>فمنذ تأسيس مجلة التجديد في عام 1997، قامت المجلة بدور رائد في نشر المعرفة الأكاديمية والفكرية، متمسكة برؤية واضحة تهدف إلى تعزيز الحوار العلمي والثقافي بين الباحثين من مختلف التخصصات. عملت المجلة على توفير منصة متخصصة لنشر الأبحاث والمقالات العلمية المحكمة. وقد ساهمت هذه الجهود في تعزيز مكانة المجلة بين الدوريات العلمية في العالم، وجعلتها وجهة أساسية للباحثين المهتمين بقضايا الفكر والدين والسياسة والاجتماع والثقافة.</p> <p>على مدار السنوات، لم تقتصر جهود المجلة على مجرد النشر، بل سعت أيضًا إلى تطوير بيئة أكاديمية محفزة للباحثين والدارسين من جميع أنحاء العالم. فقد عملت المجلة على استقطاب باحثين من خلفيات ثقافية وفكرية متنوعة، ما أتاح تبادل الأفكار والرؤى بشكل واسع وشامل. كما تبنت المجلة تحديث أساليب النشر ومواكبة التطورات الرقمية، ما سمح لها بالوصول إلى جمهور أوسع وتسهيل الاطلاع على المحتوى العلمي بسهولة ويسر، مؤكدًا على التزامها بالتأثير الإيجابي في المجتمع الأكاديمي والمجتمع العام على حد سواء.</p> <p>في عام 2025، أصبحت مجلة التجديد معترفًا بها في MyCite، وهي قاعدة بيانات وطنية في ماليزيا للمجلات الأكاديمية المحكمة، تُسجَّل فيها المجلات المعترف بها، حيث تخضع لمعايير علمية واضحة، وتتم مراجعتها أكاديميًا، وتُسجَّل اقتباساتها لتقييم أثرها البحثي.</p>رحمة أحمد حاج عثمان (Rahmah Ahmad H. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>At a time when infringements upon public property are increasingly widespread within the state, this study seeks to highlight the penalties for offences against public property under Islamic Sharīʿah and the applicable law. The researchers employ a descriptive approach and adopt a comparative methodology to examine the relationship between Islamic law and the prevailing legal framework in Palestine with the aim of preventing violations of public property, and to identify the most effective means of achieving this objective. The study addresses the conceptual definitions of its key terms and the various forms of assault on public property, demonstrating the extent of convergence between Sharīʿah and positive law in defining the notion of crime, as well as the degree of consistency between Islamic jurisprudence and statutory law in clarifying the concept of public property and establishing criteria for distinguishing it from private property. It further examines the responsibility for safeguarding public property and the penalties imposed for offences against it by identifying the parties responsible for its protection and outlining the prescribed punishments in both Islamic jurisprudence and law. The study concludes that assaults on public property take multiple forms, including theft, embezzlement, breach of trust, negligence in the performance of duties, and the misuse of public property for personal purposes, and further affirms that Islamic Sharīʿah prescribes eschatological punishments for such offences, a feature that renders it more comprehensive than positive legal systems.</p> <p><strong>Keywords:</strong> crime; public property; assault; Islamic jurisprudence and law..</p>سليم علي الرجوب (Salim Ali Rjoub)سمير محمد عواودة (Sameer M Awawde)

<p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This study examines the additions and points of divergence introduced by Ibn al-Subkī in <em>Jamʿ al-Jawāmiʿ</em> in relation to al-Bayḍāwī’s <em>Minhāj al-Wuṣūl</em>, focusing specifically on issues concerning the concept of command (al-amr) and its related discussions. Given that both works are regarded as foundational texts in the discipline of uṣūl al-fiqh, there is a clear need to identify and analyse these additions and divergences. The research problem is formulated through the following questions: What additions and divergences did Ibn al-Subkī introduce in <em>Jamʿ al-Jawāmiʿ</em> with respect to al-Bayḍāwī’s <em>Minhāj al-Wuṣūl</em> in matters related to command? What types of additions or divergences are present, and what are the underlying reasons for them? This study aims to address these questions and highlights its significance in facilitating more effective engagement with the two texts, as well as in saving time and effort for students of uṣūl al-fiqh. The study adopts a descriptive, inductive, and comparative methodology. After a thorough examination of the discussions on command in the two works, the study finds that there are six instances of addition, while no cases of divergence were identified in these issues, as all of them represent points uniquely introduced by Ibn al-Subkī in his compilation. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This study examines the daʿwah methodology in the Prophetic biography through an analytical investigation of the formation of the preacher’s character, drawing on the model of the Prophet Muḥammad ﷺ in conveying the divine message and confronting challenges. The research problem arises from the question of the essential qualities that a Muslim preacher must possess in order to be effective and successful across different times and contexts, and how these qualities may be derived from the Prophetic biography to address the challenges of contemporary daʿwah practice. The study aims to analyse the leadership qualities, formative and professional competencies, situational awareness, and ethical attributes that constituted the foundation of the success of the Prophetic mission, while presenting a practical model from which contemporary preachers may benefit. The research adopts an inductive–analytical approach in tracing Prophetic practices, alongside a critical approach that relates these qualities to the realities of present-day daʿwah work. The study arrives at several key findings, most notably that the success of daʿwah cannot be achieved solely through the possession of religious knowledge; rather, it requires the comprehensive development of the preacher’s character, grounded in steadfastness to principles, patience, informed leadership, an understanding of the nature of differences, and adherence to ethical standards in daʿwah. It further concludes that situational awareness and sensitivity to the conditions of the audience constitute two decisive elements in renewing daʿwah discourse and enhancing its impact, and that a return to the Prophetic methodology is capable of addressing many of the deficiencies evident in contemporary daʿwah practice.</p> <p><strong>Keywords:</strong> leadership; patience; situational awareness; ethics; steadfastness; compassion; coexistence.</p>سيف بن سالم بن سيف الهادي (Saif Salim Saif Alhadi)

<p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This study is founded on elucidating the objectives of iftāʾ and the legislation of rulings in contemporary banking developments, with particular emphasis on their firm grounding in the principles of ijtihād that shape the formation of a maqāṣid-oriented mujtahid muftī. The research aims to establish the objectives of iftāʾ in modern banking issues, to derive the ijtihād-based principles and Sharīʿah regulations applicable to jurists at large, and to provide an analytical exposition of their role and juridical derivation in banking fatwas. The significance of this study lies in its endeavour to regulate selected banking issues and to ensure their appropriateness in the application of legal rulings. The research problem is articulated in the following question: What ijtihād-based principles and regulatory foundations does the mujtahid muftī employ when addressing contemporary banking developments, and what is their role in selected fatwas? Given the nature of the study, the researcher adopts an inductive approach in examining the specific components of the subject matter, alongside a foundational methodology that highlights the jurisprudence of the objectives of iftāʾ through an analytical and inferential framework. Among the most significant findings is that the preparation of a mujtahid muftī must be comprehensive, achieved through the effective deployment of foundational juristic competence in harmonising fatwas with their underlying objectives. The study further concludes with a directive underscoring the necessity of integrated ijtihād-based training for specialists operating within the modern banking sector. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>Several prominent grammarians approached <em>Sībawayh’s Book</em> with criticism and revision, either by correcting what they perceived as errors or by completing what they regarded as deficiencies. Among the most notable of these was al-Mubarrid (d. 285 AH), who directed explicit criticisms at some of Sībawayh’s grammatical views. These criticisms were countered by Hārūn ibn Mūsā al-Qurṭubī (d. 401 AH), one of the Andalusian scholars of the fifth century AH, in his work <em>Sharḥ ʿUyūn Kitāb Sībawayh</em>, where he objected to those critiques and defended Sībawayh. The number of al-Qurṭubī’s objections amounts to seven, of which four models were selected for this study. These were examined in detail using a descriptive–analytical methodology, whereby the study presents Sībawayh’s views, al-Mubarrid’s criticisms, and al-Qurṭubī’s objections, alongside a discussion of the opinions of other scholars who addressed the same issues. The study then weighs and prefers between the views in light of linguistic evidence and grammatical proofs. The research arrived at a set of findings, most notably that al-Qurṭubī’s objections were not a form of conventional or uncritical defense of Sībawayh; rather, they were grounded in precise grammatical awareness and a rigorous scholarly comparison of opinions. It also showed that some of al-Mubarrid’s criticisms stemmed from a different methodological approach rather than from any flaw in the foundational principles of Sībawayh’s theory. <p>This study addresses an important subject, namely the applications of the subjective criterion in the theory of abuse of rights under the Jordanian Civil Code: an analytical and descriptive examination. The research aims to elucidate the concept of the theory of abuse of rights, to examine and analyse the subjective criterion within this theory, and to identify its applications in matters of personal status and under the Jordanian Civil Code. The research problem arises from the need for an in-depth analysis of the subjective criterion in the theory of abuse of rights and its practical application in personal status matters and Jordanian civil law. The study adopts an inductive and applied methodological approach. The findings indicate, inter alia, that the theory of abuse of rights is founded upon a set of legal principles that seek to prevent conduct that contradicts the intent of the Lawgiver in actions that are, in principle, legally permissible, thereby realising the objectives of the Sharīʿah with regard to rights and their legal effects. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This study examines the employment of the Qurʾanic patterns (ʿādāt al-Qurʾān) in Qurʾanic exegesis as articulated by Taha Jabir al-Alwani. The research problem centres on elucidating how al-Alwani utilises these patterns in order to clarify his exegetical methodology. The study aims to highlight their significance as a foundational approach to interpreting and understanding the Qurʾan in a comprehensive and integrated manner, as well as to examine their role in weighing exegetical opinions and presenting the thematic structure of Qurʾanic verses. Adopting a descriptive-analytical methodology, the study analyses selected texts from al-Alwani’s writings on Qurʾanic interpretation, identifies the most prominent Qurʾanic patterns upon which he relies in interpreting verses, and clarifies his method of employing and applying them in exegetical practice. The study concludes that Qurʾanic patterns, as utilised by al-Alwani, constitute a holistic methodological framework for understanding Qurʾanic discourse. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This article aims to examine the intellectual objections to three hadiths from Sahih al-Bukhari that were listed under the theme of "fantastical tales" in the book A Tour Through Sahih al-Bukhari: A Dialogue Between Transmission and Reason by Abd al-Ḥusayn ʿAbd al-Hādī al-ʿUbaydī. These objections stem from the content of the hadiths, which some have perceived as inconsistent with the dignity of prophetic speech. The article adopts a descriptive methodology by returning to al-ʿUbaydī’s book to identify the specific hadiths criticized by the author. Furthermore, it delves into the canonical collections of Sunnah, as well as books of hidden defects (‘ilal), historiography, biographical evaluation (ṭabaqāt), and the sciences of narrator criticism (al-jarḥ wa al-taʿdīl) in order to trace the transmission paths of the hadiths and investigate their possible flaws. In addition, the study employs a critical approach to respond to the objections and assess the authenticity of the hadiths if they are deemed weak. The conclusions reached by the article are that ʿAbd al-Ḥusayn al-ʿUbaydī is a Shiite who concealed his true identity, and that the criticisms he directed at the two categorized as amusing fictional tales are unfounded, especially when considered alongside narratives from the Qur’an. <p><strong>Abstract</strong></p> <p><strong> </strong></p> <p>This study examines the reformative framework embedded in the prophetic messages through an analytical Qur’anic reading that reconstructs the concept of corruption and its various forms as presented in revelation. It highlights the centrality of combating corruption within the prophetic mission, viewing it as a complex deviation affecting creed, values, and social structures. The study addresses a key scholarly problem: the absence of a comprehensive analytical framework that systematically links Qur’anic classifications of corruption with prophetic mechanisms of reform, beyond moralistic discourse or partial historical narration. Methodologically, the research adopts an objective analytical approach to Qur’anic texts and prophetic models, engaging in a critical dialogue with selected contemporary reform approaches that emphasize procedural regulation while neglecting moral conscience.
