(Selling the Hajj Permit Visa according to Islamic Fiqh)
This research, entitled "Selling the Hajj Permit Visa according to Islamic Fiqh,” contains three sections, introduction, and a conclusion which states the most significant findings and recommendations. The first part touched on the issue of limiting thenumber of pilgrims, and its ruling according to Islamic rule. Limiting the number of pilgrims is permissible because it is in the interest of protecting their lives.As a result use of the overcrowding in the holy places and the shrines and due to the increasing number ofkeen pilgrims to perform the Hajj, their number was determined for each Islamic country according to its population, which equals one thousand per million of its people. In the second section, I showed the legal adaptation of the selling of Hajj permit visas, and it is a personal right. The person can waive this right for financial benefits in return for compensation under specific terms. In the third section, I presented ways of selling Hajj permits visas which are spread among people, I described each way and identified the Shariah ruling of it. In the end, the research concluded that the main reason for the emerging of the so-called selling of Hajj permit is the intense competition to buy the Hajj permits, due to the limitations of pilgrims number for each country with a continuous increase in the population. The research also concluded, and that Hajj permit is one of the personal rights that can be sold under specific constraints. The researcher recommends the need to reconsider the quotas for countries by the Government of the Kingdom of Saudi Arabia, as the same selection system is being implemented for the last thirty years without revision or amendment.
