مفهوم مقاصد الشريعة وحكم التعليل بها من المسائل التي ما زالت تحتاج إلى بحث وتحرير. ويهدف هذا البحث إلى تحرير المفهوم اللغوي والاصطلاحي لمقاصد الشريعة، والنظر في إمكانية التعليل بمقاصد الشريعة. ويقوم منهج البحث على المراجعة النقدية لأهم ما تيسّر للباحث الاطلاع عليه من الكتابات المتعلقة بتلك المسائل للوصول إلى خلاصات يرى الباحث أنها تمثل إجابات معقولة عنها. وقد خلصت الدراسة إلى أنه لا يوجد من الناحية اللغوية ما يوجب التفريق بين لفظي "القصد" و"المقْصَد" في الاستعمال؛ وأن الدراسة المنهجية للمقاصد تقتضي الفصل بين الأنواع الثلاثة لمقاصد الشريعة: مقاصد الخطاب الشرعي، ومقاصد الأحكام الشرعية، ومقاصد الشارع في منهج التشريع، لتجنُّب الخلط والالتباس الذي يقع في كثير من مباحث مقاصد الشريعة. كما توصلت الدراسة إلى أنه يمكن التعليل القياسي بمقاصد الأحكام الجزئية إذا توفرت فيها الشروط التي يشترطها أصحاب المذاهب الفقهية في ركن العلة، أما مقاصد الشارع المتعلقة بمنهج التشريع فإنه لا يمكن استعمالها في التعليل القياسي، وكذلك المقاصد العامة للأحكام الشرعية.

Abstract

The meaning of maqasid al-shari'ah and its usage in qiyas still need more discussion. This article aims at determining the literal and technical meanings of maqÉÎid al-sharÊ‘ah as well as the possibility of using it in qiyyÉs. To achieve this goal, the author critically reviews the available relevant writings to make reasonable conclusions. The article concludes that: (a) there is no linguistic nor usage basis for the call to distinguish between the term “qasd” and the term “maqsid” in their technical meanings; (b) to avoid confusion, the content of maqasid al-sharÊ‘ah should not be discussed under a single heading. It should be classified under three different headings, namely: the objectives of the legal texts, the objectives of the legal rulings, and the objectives relating to the methodology of legislation; (c) the general objectives as well as the objectives relating to the methodology of legislation may not be used as basis for qiyyÉs, while the specific objectives of legal rulings may be used if they meet the requirements of 'illah.
