يتناول هذا البحث موضوع التطور الدلالي للمصطلح الأصولي الفقهي، فيؤصَّل من الناحية النظرية لمفهوم التطور الدلالي، ومجالاته، وأسبابه، والأبعاد التي يكتسبها المصطلح عبر مراحل تطوره، ويرصد من الناحية التطبيقية مجموعةً من المصطلحات الأصولية والفقهية التي لحقها التطور، أو تلك المرشحة لأن يلحقها التطور. وقد  البحث إلى مجموعة من النتائج، من أهمها أن العلماء تعاملوا مع المصطلحات بعقلية اجتهادية مرنة لا تولي للألفاظ القدر الأكبر من الاهتمام إذا تمَّ إحكام المعنى، وأنَّ قابلية المصطلح الأصولي الفقهي للتطور الدلالي تعكس مدى مرونة هذا العلم لمواكبة الحاجات المتغيرة بتغير الزمان والمكان، فلا يقف عاجزًا أمام عقبة المصطلح، وأنه لا خشية مع حصول التطور الدلالي من فوضى اصطلاحية؛ لأنَّ للتطور مجالًا لا يتجاوزه إلى غيره، وهو مجال المصطلحات التي لديها قابلية للتطور، أما تلك المصطلحات الثابتة التي تمثل الهوية الدينية للأمة في مجالي العقيدة، والعبادة والقيم فلا مجال لإحداث تطور دلالي عليها.

Abstract

This article examines the issue of semantic change in Islamic jurisprudential terminology with regard to both legal legal theory and positive law. It first lays down the the theoretical underpinnings of the concept of semantic change, and sheds light on its domain, causes and the diemnsions that technical terms acquire in different stages of semantic change. Then, at the practical level, the article identifies a number of Islamic jurisprudential terms that have actually undergone semantic change or that are prone to undergone such change. Of the findings arrived at in the study the following are the most important: 1. Muslim scholars dealt with the issue of technical terms with a creative open spirit that does not ascribe more importance to words so far as meanings are distinctly made clear. 2. The susceptibility of technical jurisprudential terms to semantic change reflects the flexible nature of Islamic legal theory and law and its capacity to to keep pace with the changing needs of time and space, whereby it does not find itself in a standstill because of terminology. 3. There is no fear that terminological anarchy would arise due to semantic change of terms, as such change is limited to well defined areas in which terms are open to change by their very nature, while such unalterable terms as pertaining to to the religious identity of the Muslim community in matters of faith, devotional worship and vlues are not subject to semantic change.

Abstrak

Artikel ini mengkaji isu perubahan semantik dalam istilah jurisprudens Islam dengan mengambil kira teori perundangan dan undang-undang positif dalam Islam. Pertamanya, artikel ini meletakkan asas di sebalik teori konsep perubahan semantik dan penjelasan tentang skop, punca dan dimensi penggunaan istilah tersebut pada peringkat perubahan semantik. Pada peringkat praktikal, artikel ini mengenal-pasti beberapa istilah jurisprudens Islam yang benar-benar melalui perubahan semantik atau yang terdedah kepada perubahan tersebut. Berdasarkan dapatan kajian, berikut merupakan isu yang penting: 1. Sarjana Islam secara terbuka dan kreatif dapat menangani isu pengistilahan dengan tidak saja mementingkan pemilihan perkataan malah melihat kejelasan maknanya. 2. Kecenderungan istilah teknikal dalam jurisprudens Islam kepada perubahan semantik mencerminkan teori dan perundangan Islam begitu anjal sehingga berupaya untuk bersaing dengan perubahan masa dan tempat sehingga tidak bersifat statik dengan sesuatu istilah. 3. Tidak perlu timbul rasa gerun berlakunya anarki istilah atas sebab perubahan semantik. Ini kerana perubahan terhad kepada skop yang tertentu, dan istilah berubah atas sifatnya yang tersendiri, manakala aspek tidak boleh ubah seperti identiti keagamaan dalan masyarakat Islam termasuk hal-hal berkaitan dengan keimanan, ibadah dan nilai-nilai baik tidak tertakluk kepada perubahan semantik.
