(Child Custody Laws: A Fiqh Study in Light of Kuwaiti Family Law)

 This paper examines the issue of child custody, an important issue for Kuwaiti society given the increasing number of divorces. It addresses the rulings of various fiqh schools and Kuwaiti law in this regard. By employing a comparative, descriptive and analytical approach, the paper explains the concept of custody, the right to custody, custody conditions and duration, and other issues such as payment of custody and travelling with the child. The paper concludes with a number of recommendations to develop custody law in Kuwait through various means that include amending and activating certain laws, enhancing governmental efforts in spreading awareness about custody and the welfare of children.
