إذا كان الوجود الإسلامي بالغرب عمومًا يتطوّر على نسق سريع في كمّه وكيفه، فإنّ أهدافه والآمال المستقبلية التي يستشرفها سوف يطالها هي أيضًا التغيّر والتطوّر. فتلك الأهداف والآمال لمّا كان هذا الوجود يتمثّل في عدد قليل من  المسلمين لم يكن للأسر وللجيل الناشئ فيهم حضور كثيف ليست هي ذات الأهداف والآمال حينما أصبح هذا العدد يُعدّ بعشرات الملايين من بينهم العدد الكبير من الأسر والأجيال الناشئة. وكذلك فإنّه لما كان هذا الوجود الإسلامي يعتبر نفسه وجودًا عارضًا غايته العودة إلى بلاد المنشإ لم تبق تلك الغاية هي ذاتها لما أصبح يعتبر نفسه وجودًا مواطنًا ثابتًا يشكّل مكوّنًا أساسيًّا من مكوّنات المجتمع الأوروبي. وبالنظر إلى ما تقدّم فلعلّ السؤال المهمّ الذي يطرح نفسه في بناء استراتيجية الفقه الإفتائي للأقليات المسلمة في أوروبا هو: كيف يمكن إقامة معادلة صحيحة لبناء فقه للأقلّيات المسلمة بين ما تقتضيه المرحلة العرضية للوجود الإسلامي من فتوى تميل إلى الترخيص بحكم الطبيعة الاستثنائية لتلك المرحلة، وما تقتضيه مرحلةُ المواطنة من فتوى تميل إلى التأسيس بحكم طبيعتها المستقرّة؟ إنّ الجواب على هذا السؤال يقتضي شرحًا أوفى لطبيعة المرحلتين في أبعادها المختلفة، وبيانًا لطبيعة ما تقتضيه كلٌّ منهما من الفقه الإفتائي، حتى يتمّ بعد ذلك بناء المعادلة بين فقه الترخيص وفقه التأسيس كخطّ أساسي من خطوط الاستراتيجية الهادية لفقه الإفتاء في شأن الأقليات المسلمة، وهذا ما سنحاول القيام به في هذا البحث بعون الله تعالى.

                                         Abstract

If Muslim presence and existence in the West, generally speaking, has been evolving quite fast both in terms of size and quality, its goals and aspirations will also be subject to change and evolution. As this presence and existence now counts by tens of millions of Muslims including scores of families and new generations, its goals and aspirations cannot be the same as when it was limited to small numbers of individuals mostly without families and attendant descendants. Moreover, as Muslim presence and existence in the West has started considering itself as a permanently resident community with its members being citizens of the countries in which they live and constituting integral components of European societies, its ends cannot be the same as when it was embodied in individuals who looked at themselves as mere travelers whose ultimate aim was to return to their countries of origin. In light of this situation, the most important question that arises with regard to developing a strategy of Islamic jurisprudence and issuance of fatwÉ (legal opinion) catering for the needs of Muslim minorities in Europe is the following: how to realize a proper equation for developing a Muslim-minorities-related jurisprudence fulfilling, on the one hand, the needs of the temporary stage of Muslim presence based on the rule license due to the exceptional situation of that presence and, on the other, coping with the requirements of the new stage of its becoming a permanent and lasting presence? The answer to this question calls for an elaborate explanation of the nature of the two stages in all its dimensions as well as of the nature of fatwa necessitated by each stage. This is necessary in order to work out the needed equation of license-oriented (fiqh al-tarkhīÎ) and constructive/foundational (fiqh al-ta’sīs) jurisprudence as one of the major aspects of the strategy that shall guide the fiqh/fatwa dealing with the affairs of Muslim minorities. This is what the author attempts to address in this article by God’s grace.

Abstrak

Jika kehadiran Islam di Barat umumnya berkembang dalam dengan cepat, begitu juga halnya tujuan dan hala tujunya untuk masa depan. Ini adalah kerana tujuan dan harapan kehadiran sejumlah kecil umat Islam dahulu  tida sama ketika populasi itu kini dalam bilangan puluhan juta yang meliputi jumlah keluarga yang besar dan kelahiran generasi-generasi baharu. Kehadiran penduduk Muslim tidak lagi untuk tujuan sekadar mencari rezki dan kemudian kembali ke negara asal mereka kerana mereka kini menganggap diri mereka sebagai warga negara yang memiliki tempat tinggal kekal yang membentuk komponen penting dalam masyarakat Eropah moden. Oleh itu, soalan yang paling penting yang timbul dalam membina prinsip strategik untuk mengeluarkan fatwa berkenaan isu-isu yang berkaitan dengan minoriti Muslim di Eropah adalah: bagaimanakah untuk  menemukan formula yang tepat untuk membina asas fiqh untuk mereka. Ini adalah berkaitan dengan keperluan untuk menyeimbangkan antara apa yang diperlukan untuk mengeluarkan fatwa bedasarkan konteks yang sedia ada dan isu-isu luar biasa yang timbul di satu pihak, dan pembentukan dasar yang kukuh untuk mengeluarkan fatwa yang bersesuaian dengan hak-hak kewarganegaraan dan kewujudan kekal mereka di negara-negara Eropah tersebut. Jawapan kepada persoalan ini memerlukan penjelasan yang lebih luas untuk memahami tabiat perkembangan kehidupan dari pelbagai aspek, dan tabiat setiap proses yang perlu diikuti untuk menerbitkan sesuatu fatwa. Melainkan ini tercapai, formula untuk menentukan keseimbangan antara keperluan untuk meringankan beberapa masalah dan keperluan untuk menetapkan satu prinsip berpanjangan untuk menjadi asas dalam mengeluarkan fatwa bagi penduduk minoriti Muslim tidak dapat dicapai. Ini adalah apa yang akan dicuba oleh kertas ini  demi untuk untuk melakar satu pelan tindakan yang mampan dalam menyelesaikan isu ini.
