(The Theological Foundation of Ijtihad and Its Impact on the Adoption of Artificial Intelligence in Religious Legislation)
Abstract
This research paper aimed to analyze the feasibility of adopting artificial intelligence (AI) in the process of ijtihad (independent legal reasoning) within religious legislation, by examining the theological foundations related to this process. The paper begins with a linguistic and technical definition of ijtihad, tracking its development within the framework of usul al-fiqh (the principles of Islamic jurisprudence). It also discusses the theological framework as a necessary condition for ijtihad and the qualifications of the mujtahid (jurist). The paper then analyzes the rationale behind this theological foundation and its impact on the potential use of AI in ijtihad, considering both the mechanisms of AI and the humanity of its programmer. The study followed a descriptive-analytical approach, with a comparison between human ijtihad and machine-based ijtihad. The findings concluded that ijtihad is not solely an intellectual process but is closely tied to theological beliefs, which limits the possibility of replacing human jurists with AI in religious legislation.
