Abstract

In some limits of kaffarah, the scriptural text must be adhered to as Allah has ordained following the text, as in the case of murder and zhihar. Thus, it is necessary to follow the letter of the law as in the case of specifying freeing a Muslim in the kaffarah for murder. There is not such specification in the case of zhihar and thus the letter of the law can also be followed. However, the letter of the law can be passed over to the spirit of the law as in the case of paying money instead of food and in the case of paying one poor person instead of sixty poor people. This does not mean it is illegal to offer food as kaffarah or to pay sixty people, for this would mean cancelling the letter of the law. When the spirit of the law is followed, the objectives of the law are achieved, such as satisfying the needs of the poor.
