في ظل التطور المتسارع لتقنيات الذكاء الاصطناعي وتزايد الاعتماد عليها في مختلف القطاعات، برزت تحديات قانونية جديدة، لا سيما فيما يتعلق بتحديد المسؤولية المدنية عن الأضرار الناشئة عن هذه الأنظمة. وتزداد هذه التحديات تعقيدًا في ظل غياب تنظيم تشريعي خاص يعالج أضرار الذكاء الاصطناعي ضمن العديد من الأنظمة القانونية، بما في ذلك التشريع الإماراتي. تهدف هذه الدراسة إلى بحث المسؤولية المدنية عن أضرار تطبيقات الذكاء الاصطناعي في ضوء النظريات التقليدية، مع التركيز على نظرية مسؤولية المتبوع عن أعمال تابعه، ونظرية حراسة الأشياء والآلات وفقًا لأحكام قانون المعاملات المدنية الإماراتي، وذلك لتقييم مدى ملاءمتها لمعالجة هذا النوع المستحدث من الأضرار. كما تسعى الدراسة إلى تحليل مدى كفاية هذه النظريات في مواجهة الخصائص المميزة للأنظمة الذكية، خاصة في ظل ما تتمتع به من درجة من الاستقلالية. وقد اعتمدت الدراسة على المنهج الوصفي التحليلي من خلال تحليل النصوص القانونية والآراء الفقهية ذات الصلة. وتخلص الدراسة إلى أن النظريات التقليدية، رغم أهميتها، لا تكفي بذاتها لمعالجة أضرار الذكاء الاصطناعي، الأمر الذي يستدعي تطويرًا تشريعيًا يواكب طبيعة هذه التكنولوجيا ويضمن حماية قانونية فعالة.
