(القرض الحسن وتحقيق المقاصد الشرعية في المجتمعات الإسلامية في ظل جائحة كورونا (كوفيد 19 The goodly Loan and the Realization of Shari'ah Purposes in Islamic Societies under the effect of Coronavirus (COVID-19)

الملخص

تأتي هذه الدراسة من أجل إبراز الدور الÙاعل للقرض الحسن ÙÙŠ حل مشكلات المجتمعات الإسلامية المنكوبة ÙÙŠ جائحة كورونا، من خلال تحقيق مقاصد الشارع المختلÙØ©ØŒ وللكش٠عن وسائل تحقيق مقاصد التنمية بين الشعوب الإسلامية عن طريق Ùتح مشاريع ناÙعة وصالحة للحÙاظ على كيان المجتمع المسلم، ولا ريب أن القرض الحسن يحقق التوازن والعدل والتكاÙÙ„ بين كاÙØ© أعضاء المجتمع المسلم، قال الله تعالى: (مَّن ذَا الَّذÙÙŠ ÙŠÙقْرÙض٠اللَّهَ قَرْضًا حَسَنًا ÙÙŽÙŠÙضَاعÙÙَه٠لَه٠أَضْعَاÙًا ÙƒÙŽØ«Ùيرَةً Ûš وَاللَّه٠يَقْبÙض٠وَيَبْسÙØ·Ù ÙˆÙŽØ¥Ùلَيْه٠تÙرْجَعÙونَ (البقرة: 245( وقد جاءت نصوص كثيرة من الكتاب والسنة لترسيخ هذا المبدأ، وقد أسÙرت الدراسة عن العلاقة الوطيدة بين مقاصد الشريعة والقرض الحسن، حيث قمت باستقراء أنواع المقاصد وأقسامها باعتبارات مختلÙØ©ØŒ ووجدت العلاقة الوثيقة بين القرض الحسن والمقاصد الضرورية والحاجية، وكذلك المقاصد الكلية والمقاصد الخاصة والقطعية، وكشÙت الدراسة أوجه الاستÙادة من القرض الحسن ØŒ حيث يتطلب تكات٠الجهود للنهوض بنظام القرض الحسن من أجل الحماية الاجتماعية، والقيام بدعم الشركات المتضررة من تداعيات كورونا وإنشاء صنادقيق للطوارئ وتمويل المشاريع الداعمة للشباب وغيرها.

Abstrsct

This study comes to highlight the effective role of the goodly Loan in solving the problems of Islamic societies afflicted by the Corona pandemic, by achieving the various purposes of Islamic Shari'ah, and to uncover the means to achieve the goals of development among Islamic peoples by opening beneficial and valid projects to preserve the existence of the Muslim community. A goodly loan achieves balance, justice and solidarity among all members of the Muslim community. The Almighty said: "Who is it that would loan Allah a goodly loan so He may multiply it for him many times over? And it is Allah who withholds and grants abundance, and to Him you will be returned" (Al-Baqarah: 245).The study resulted in the close relationship between the objectives of Sharia and the goodly loan, as I extrapolated the types of purposes of Shari'ah and their divisions with different considerations, and found the close relationship between the goodly loan and the necessary and needy objectives, as well as the overall objectives and the private and definitive purposes. The study revealed aspects of benefiting from the goodly loan, as it requires concerted efforts to advance the good loan system for social protection, support companies affected by the repercussions of Corona virus, establish emergency funds and finance projects that support youth and others.
