الملخص

تهد٠هذه الورقة البحثية إلى بحث الأسس الشرعية التي بنيت عليها القرارات بشأن الأسهم الممتازة، سواءً بالتحريم أو الإجازة. تعد المسائل التي تضاربت حولها الأحكام الشرعية من القضايا الشائكة التي تستحق العناية بها ودراستها وبحثها بحثا معمقا، للتوصل إلى النقاط المؤتلÙØ© والمختلÙØ© بين الآراء المتعددة. يعتمد البحث على الطريقة الاستقرائية المسحية بتتبع الأدلة المتباينة، وتصنيÙها، والمقارنة بينها. جمع البحث ÙÙŠ طياته كل الأقوال الواردة ومرتكزاتها الشرعية والمنطقية وقارن بينها بكل Ø´ÙاÙية، كما أن محدودية وقلة البحوث حول الأسهم الممتازة أعطت لهذا البحث قيمة مضاÙØ©ØŒ لا سيما وأنه الأول من نوعه ÙÙŠ جمع ومقارنة كل الأدلة والحلول الواردة ÙÙŠ المسألة.

Abstract

This study aims to examine the Shari'ah opinions in respect of preference share and the bases upon which the opinions are made. The controversial issues where the Shari'ah rulings have clashed are among the thorny issues that deserve extra in-depth attention, study and research, in order to arrive at the main points of similarities and differences between the various opinions. The research is based on the librarian inductive survey method by tracking the disparity of Shari'ah evidences before classifying and comparing them, for the purpose of arriving at the right decision. The research combines all the Shariah rulings in this topic, and their Islamic and logic basis, and compared them transparently. Also, the limited number of researches on preference shares gave this research an added value, especially as the first one that combine and compare all the evidence and solutions proposed in this issue.
