الملخصتبحث هذه الدراسة موضوع العقود الصورية في المصارف الإسلامية، -التورق المصرفي المنظم أنموذجا، فتهدف إلى بيان مفهوم العقود الصورية وذكر شروطها، كما تسعى لتوضيح العلاقة بينها وبين الحيل وبيان حكمهما، بالإضافة إلى ذلك فإنها تُركِّز على التورق المصرفي المنظم، حيث تُوضِّحُ صورته وتبين حكمه والفروق بينه وبين التورق الفردي، وقد اعتمدتْ لتحقيق ذلك المنهج الاستقرائي التحليلي المقارن لجمع وتتبع كل ما يتعلق بالعقود الصورية، مع تحليلها ومقارنة صورها القديمة بالحديثة المعاصرة، فتوصل الباحث من خلال ذلك أن العقود الصورية تأخذ حكم الجواز إن كان الهدف منها إثبات حق، أو حفظ مال مظلوم، أو منع مظلمة... والتحريم إن كانت الغاية منها التحايل على الشرع للوصول إلى المحرمات، كما خَلُصَ أيضا إلى جواز التورق الفردي، وعدم جواز التورق المصرفي المنظم مع بيان علل ذلك، بعد بسط صورتهما والفروق بينهما.
Abstract:
This study investigates the issue of simulated contracts in Islamic banks, with a focus on organized banking tawarruq. It aims to clarify the concept of fictitious contracts, list their conditions, and explain the relationship between them and guile, as well as their rulings. In addition, it focuses on organized banking tawarruq, clarifying its form, ruling, and differences from individual tawarruq. To achieve this, the study adopted inductive, analytical, and comparative methods to collect and track everything related to fictitious contracts, analyze them, and compare their old and modern forms. The researcher concluded that simulated contracts are permissible if their purpose is to establish a right, protect the property of an oppressed person, or prevent an injustice. They are forbidden if their purpose is to circumvent the Shari'a to achieve prohibited things. The researcher also concluded that individual tawarruq is permissible, while organized banking tawarruq is not. He explained the reasons for this after explaining the forms of both and the differences between them.
