Re-engineering Awqaf through Islamic Banking: A Maqāsīdīc Study in Light of the Malaysian Experience

ABSTRACT
This study examines the strategic partnership frameworks between Waqf institutions and Islamic banking entities in the Malaysian model, highlighting the structural and operational challenges facing the enhancement of Waqf's role in contemporary socio-economic development. The research addresses three primary axes: First, the theoretical foundations for integration between Waqf and Islamic banking systems in the Malaysian context; second, analysis of regulatory and supervisory frameworks for Waqf management within the Islamic banking system; and third, case studies of pioneering Islamic banking models in Waqf development. The study employed a multi-dimensional methodology combining an inductive approach to trace the historical-legislative evolution of the relationship between sectors, an analytical method to examine organizational structures and operational mechanisms, and a Maqāsīd-based approach to evaluate the alignment of banking practices with Sharī'ah objectives. The findings revealed an integrated theoretical framework combining both systems with notable compatibility with Sharī'ah objectives, alongside varying effectiveness in implemented governance mechanisms. The study recommended developing a unified regulatory framework through establishing an independent national coordination and supervision authority, focusing on innovating specialized Islamic financial products such as Waqf Sukuk and Waqf investment funds, ensuring compliance with Maqāsīd al- Sharī'ah and contemporary market requirements, while enhancing operational efficiency and financial sustainability of Waqf institutions.
