Sawari sawari@iium.edu.my <p><strong>الملخص:</strong></p> <p>يتناول هذا البحث تحليل تأصيل لبنود المعيار الشرعي للاستصناع والاستصناع الموازي الصادر عن هيئة (أيوفي)؛ وتكمن أهمية البحث في سد الفجوة العلمية وضبط الممارسات المالية المعاصرة عبر مراجعة المعايير الاجتهادية التي لم تسبقها دراسات شرعية كافية من قبل الهيئة. وقد اعتمدت الدراسة على المنهجين الاستقرائي والتحليلي لحصر المادة العلمية من مصادرها الأصيلة وفحص النصوص لاستنباط الأحكام الفقهية المنظمة لها، وخلصت إلى نتائج عدة أبرزها ترجيح مشروعية الاستصناع الموازي لاستقلال صفقاته وانتفاء شبهة الربا فيه، مع تقديم نقد منهجي لتحديد نسبة الملكية المانعة بـ (الثلث) واقتراح رفعها لـ (النصف) تحقيقاً للاتساق مع المعايير الأخرى للهيئة. كما أوصت الهيئة بمنع اشتراط الضمان مدى الحياة لما يتضمنه من جهالة وغرر، بالإضافة إلى الدعوة للمرونة في تحديد الثمن بناءً على التكلفة الحقيقية لمواكبة تقلبات الأسعار في المشاريع الطويلة وفقاً لمقترحات مجمع الفقه الإسلامي.</p> <p><strong>Abstract:</strong></p> <p>This research provides a foundational analysis of the clauses within the Sharia Standard for&nbsp;Istisna’a&nbsp;and&nbsp;Parallel Istisna’a&nbsp;issued by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI). The significance of this study lies in bridging the academic gap and regulating contemporary financial practices by reviewing the jurisprudential (<em>Ijtihadi</em>) standards that lacked sufficient prior Sharia studies by the organization. Employing both inductive and analytical methodologies, the study surveys scientific material from its original sources and examines relevant texts to derive the governing Sharia rulings. The findings primarily support the Sharia permissibility of Parallel Istisna’a due to the independence of its respective contracts and the absence of any suspicion of&nbsp;Riba&nbsp;(usury). Furthermore, the research presents a methodological critique regarding the limitation of the prohibiting ownership stake at&nbsp;one-third, proposing instead to increase it to&nbsp;one-half&nbsp;to ensure consistency with AAOIFI’s other standards. The study also recommends prohibiting the stipulation of "lifetime guarantees" due to the inherent uncertainty (<em>Jahala</em>) and risk (<em>Gharar</em>) involved. Finally, it calls for greater flexibility in price determination based on actual costs to accommodate price fluctuations in long-term projects, in accordance with the proposals of the&nbsp;International Islamic Fiqh Academy.</p> 2026-06-14T00:00:00+08:00 Copyright (c) 2026 International Journal of Al-Turath In Islamic Wealth and Finance https://journals.iium.edu.my/iiibf-journal/index.php/ijaiwf/article/view/1125 أثر الإنفاق الحكومي على ربحية البنوك الإسلامية مقارنة مع البنوك التقليدية ذات النوافذ الإسلامية في ليبيا 2026-07-14T23:58:06+08:00 Hasan Hamal hassan09691@gmail.com Abdulmajid Obaid alamri@iium.edu.my Fahd Shaghari alshaghdari@iium.edu.my <p><strong>ملخص الدراسة</strong></p> <p>هدفت هذه الدراسة إلى قياس أثر الإنفاق الحكومي على ربحية البنوك الليبية خلال الفترة الممتدة من عام 2017 إلى عام 2024، مع إدخال نوع البنك كمتغير مُعدِّل للمقارنة بين البنوك الإسلامية والبنوك التقليدية ذات النوافذ الإسلامية. ولتحقيق هذا الهدف، تم الاعتماد على المنهج الكمي الوصفي التحليلي باستخدام بيانات بانل لستة مصارف ليبية، وتم تحليلها بواسطة برنامج R (4.5.1) من خلال نموذج الانحدار الخطي المتعدد مع اختبار التفاعل بين الإنفاق الحكومي ونوع البنك. وأظهرت النتائج وجود دور مُعدِّل أساسي وذو دلالة إحصائية لنوع البنك، حيث يغيّر النموذج المصرفي من طبيعة العلاقة بين الإنفاق الحكومي والربحية. كما تبين أن الإنفاق الحكومي يمارس أثراً إيجابياً وذا دلالة إحصائية على العائد على حقوق الملكية في البنوك التقليدية، مما يعكس قدرتها على الاستفادة من النشاط الاقتصادي العام، في حين يتحول الأثر إلى سلبي على عائد الأصول في البنوك الإسلامية نتيجة قيود نموذج التمويل الإسلامي وضعف المرونة في استغلال الإنفاق العام. وتؤكد النتائج وجود تباين بنيوي في الكفاءة التشغيلية بين المجموعتين المصرفيتين، حيث تظهر البنوك التقليدية تفوقاً في إدارة الأصول والخصوم والتكيف مع تقلبات بيئة الاقتصاد الكلي. بناءً على ذلك، توصي الدراسة بضرورة تعزيز التنوع في نماذج الأعمال المصرفية الإسلامية عبر تطوير أدوات تمويلية إنتاجية متوافقة مع الشريعة، وتحسين كفاءة توجيه الإنفاق الحكومي نحو القطاعات المنتجة، إضافة إلى تبني سياسات رقابية وتشريعية أكثر مرونة من قبل مصرف ليبيا المركزي لدعم قدرة البنوك الإسلامية على التكيف مع الدورات المالية وتعزيز ربحيتها واستدامتها في المدى الطويل.</p> <p><strong>Abstract</strong></p> <p>This study aimed to measure the impact of government spending on the profitability of Libyan banks during the period from 2017 to 2024, introducing bank type as a moderating variable to compare Islamic banks with conventional banks offering Islamic windows. To achieve this objective, a descriptive-analytical quantitative approach was employed, utilizing panel data from six Libyan banks. This data was analyzed using R (4.5.1) software through a multiple linear regression model, along with an interaction test between government spending and bank type. The results demonstrated a statistically significant moderating role for bank type, indicating that the banking model alters the nature of the relationship between government spending and profitability. Furthermore, the study revealed that government spending exerts a statistically significant positive impact on the return on equity (ROE) of conventional banks, reflecting their ability to capitalize on overall economic activity. Conversely, the impact becomes negative on the return on assets (ROA) of private Islamic banks due to the constraints of the Islamic finance model and the limited flexibility in utilizing public spending. The findings confirm a structural disparity in operational efficiency between the two banking groups, with conventional banks demonstrating superiority in asset and liability management and adapting to macroeconomic fluctuations. Accordingly, the study recommends enhancing the diversification of Islamic banking business models by developing productive, Sharia-compliant financing instruments, improving the efficiency of directing government spending towards productive sectors, and adopting more flexible regulatory and legislative policies by the Central Bank of Libya to support the ability of Islamic banks to adapt to financial cycles and enhance their profitability and long-term sustainability.</p> 2026-06-14T00:00:00+08:00 Copyright (c) 2026 International Journal of Al-Turath In Islamic Wealth and Finance https://journals.iium.edu.my/iiibf-journal/index.php/ijaiwf/article/view/1126 STAKEHOLDER PERCEPTIONS OF ZAKAH AS A TOOL FOR POVERTY ALLEVIATION IN KATSINA STATE, NIGERIA 2026-07-15T00:49:24+08:00 Habeebullah Zakariyah habzak@iium.edu.my Umar Muhammad Aljazira umaljazira@fudutsinma.edu.ng <p><strong>Abstract</strong></p> <p>Zakah constitutes a foundational pillar of Islamic social finance and is intended to function as a compulsory redistributive mechanism for poverty alleviation and social justice. In Nigeria, particularly in the northern states where poverty incidence is highest, Zakah has been re-institutionalized through state-level boards and local committees. Despite these efforts, the extent to which Zakah effectively addresses poverty remains contested, largely due to governance and institutional challenges. This study examines stakeholder perceptions of Zakah as a poverty alleviation tool in Katsina State, Nigeria. Using a qualitative research design, data were collected through in-depth interviews, focus group discussions, document analysis, and field observations involving donors, beneficiaries, religious leaders, and Zakah administrators. Data were analyzed thematically using ATLAS.ti 8. Findings reveal that while stakeholders acknowledge Zakah’s contribution to food security, healthcare access, and short-term livelihood support, its broader developmental impact is constrained by weak governance, limited transparency, logistical inefficiencies, low public awareness, and declining donor trust. Beneficiaries report delays and inconsistencies in access, while administrators highlight capacity and funding constraints. The study concludes that institutional reform, digitalization, enhanced stakeholder engagement, and a shift toward productive Zakah are critical for strengthening Zakah’s poverty-alleviation impact in Katsina State.</p> 2026-06-14T00:00:00+08:00 Copyright (c) 2026 International Journal of Al-Turath In Islamic Wealth and Finance https://journals.iium.edu.my/iiibf-journal/index.php/ijaiwf/article/view/1132 التكييف الفقهي والتوافق الشرعي للمنصات التجارية الرقمية في ماليزيا: دراسة تحليلية 2026-07-30T01:46:08+08:00 Aziyah Binti Mohamad Shauki ziezie_libra@yahoo.com.my Saheed Abdullah Busari saheed@iium.edu.my Hossam El-Din Ibrahim hossam@iium.edu.my Muaadh Mustafa Ali Mukred m.muaadh@yahoo.com <p><strong>الملخص</strong></p> <p>هدفت هذه الدراسة إلى بيان التكييف الفقهي للمنصات التجارية الرقمية في ماليزيا وتحليل مدى توافقها مع أحكام الشريعة الإسلامية، من خلال دراسة عدد من أبرز المنصات المستخدمة في السوق الماليزية، وهي: Shopee وLazada وTikTok Shop وZALORA وPG Mall وYoubeli. واعتمدت الدراسة على المنهج الوصفي التحليلي من خلال تحليل الوثائق الرسمية للمنصات، وشروط الاستخدام، والدراسات السابقة، والقرارات الفقهية المعاصرة ذات الصلة بالتجارة الإلكترونية والمعاملات الرقمية.وتوصلت الدراسة إلى أن الأصل في المنصات التجارية الرقمية الإباحة؛ لأنها تمثل وسائل تقنية حديثة لتيسير عمليات البيع والشراء، وأن التكييف الفقهي الغالب لها يتمثل في عقود السمسرة أو الوكالة أو الإجارة على الخدمات الإلكترونية بحسب طبيعة النشاط الذي تؤديه المنصة. كما أظهرت النتائج أن معظم المنصات محل الدراسة لا تخضع لرقابة شرعية مؤسسية شاملة، باستثناء بعض المنتجات المالية المحددة، مثل خدمة SPayLater التابعة لمنصة Shopee التي حصلت على اعتماد شرعي من جهة استشارية متخصصة. وفي المقابل، تبين وجود إشكالات شرعية في بعض الخدمات التمويلية المرتبطة بمنصات أخرى، ولا سيما خدمة LazPayLater التي تعتمد على الفائدة بصورة صريحة. وأوصت الدراسة بضرورة تعزيز الحوكمة الشرعية للمنصات التجارية الرقمية، ووضع معايير شرعية موحدة لتقويم الخدمات المالية والتجارية المرتبطة بها.</p> <p><strong>Abstract</strong></p> <p>This This study examines the Islamic legal characterization (takyīf fiqhī) and Shariah compliance of selected digital commercial platforms in Malaysia, namely Shopee, Lazada, TikTok Shop, ZALORA, PG Mall, and Youbeli. Using a descriptive-analytical approach, the study analyzes official platform documents, terms and conditions, and relevant fiqh literature. The findings indicate that digital commercial platforms are generally permissible under Islamic law, as they primarily function as intermediaries facilitating online transactions. Their legal characterization is mainly associated with brokerage (simsārah), agency (wakālah), and service contracts (ijārah). The study further finds that most platforms do not operate under comprehensive Shariah governance frameworks, although certain financial products, such as SPayLater, have obtained Shariah certification. In contrast, some services, particularly LazPayLater, raise Shariah concerns due to the application of interest-based charges. The study concludes that the Shariah ruling on these platforms depends largely on the nature of the transactions and financial mechanisms conducted through them rather than on the platforms themselves.</p> 2026-06-14T00:00:00+08:00 Copyright (c) 2026 International Journal of Al-Turath In Islamic Wealth and Finance https://journals.iium.edu.my/iiibf-journal/index.php/ijaiwf/article/view/1133 معالجة المآخذ والأسباب التي حالت من انتشار المشاركة المتناقصة في ضوء مقاصد الشريعة 2026-07-30T10:59:33+08:00 Waleed Abdulsalam Mohammed Abuhamra abuhamra86@gmail.com Habeebullah Zakariyah habzak@iium.edu.my Abdulmajid Obaid Hasan Saleh alamri@iium.edu.my <p><strong>الملخص</strong></p> <p>يتناول هذا البحث دراسة للمشاركة المتناقصة كبديل استثماري أصيل في المصارف الإسلامية، يسعى لتحقيق مقاصد الشريعة في المال. يبدأ البحث بتشخيص الواقع الذي يظهر هيمنة عقود المداينات بنسبة تفوق 88%، وهو ما يخالف الفلسفة التأسيسية للبنوك الإسلامية القائمة على تقاسم الربح والخسارة. ويحلل البحث الأسباب التي أدت لهذا العزوف، ومن أبرزها: الرغبة في ضمان الربح ورأس المال، ونقص الكوادر المؤهلة، والمخاطر الأخلاقية والتشغيلية، فضلاً عن النقص التشريعي الذي يؤدي أحياناً لتكييف هذه العقود قضائياً كقروض تجارية عادية. تثبت الدراسة من خلال المنهج المقاصدي أن المشاركة المتناقصة تتفوق على المرابحة والتورق في تحقيق مقاصد الوضوح، والرواج، والعدل، والبعد عن التحايل الربوي. وتخلص الدراسة إلى مجموعة من التوصيات العملية، أهمها: ضرورة التزام المصارف بمعايير (AAOIFI)، وتطوير الموارد البشرية، وتحسين دراسات الجدوى، وتوعية المستثمرين إعلامياً، مع التأكيد على ضرورة تدخل المشرع القانوني لحماية خصوصية هذه المعاملات، وصولاً إلى توازن حقيقي بين عقود المداينات، والمشاركات، بما يخدم التنمية الاقتصادية الشاملة.</p> <p><strong>Abstract</strong></p> <p>This research provides an in-depth study of Diminishing Musharakah as an authentic investment alternative in Islamic banks, aiming to achieve the objectives of Shari'ah (Maqasid) in wealth. The study begins by diagnosing the current situation, which shows the dominance of debt contracts by over 88%, contradicting the foundational philosophy of Islamic banks based on profit and loss sharing. The research analyzes the reasons leading to this reluctance, most notably: the desire to guarantee profit and capital, the lack of qualified personnel, ethical and operational risks, as well as the legislative deficiency that sometimes leads to judicial adaptation of these contracts as regular commercial loans. Through the Maqasid approach, the study proves that Diminishing Musharakah is superior to Murabahah and Tawarruq in achieving the objectives of clarity, circulation, justice, and avoiding usurious circumvention. The study concludes with a set of practical recommendations, the most important of which are: the necessity for banks to adhere to AAOIFI standards, human resource development, improving feasibility studies, and media awareness for investors, while emphasizing the need for legislative intervention to protect the specific nature of these transactions, ultimately reaching a true balance between debt and partnership contracts to serve comprehensive economic development.</p> 2026-06-14T00:00:00+08:00 Copyright (c) 2026 International Journal of Al-Turath In Islamic Wealth and Finance
