TY - JOUR AU - Muntaha Artalim, منتهى أرتاليم PY - 2014/05/13 Y2 - 2024/03/29 TI - حولَ نسبة "الشروط العُمريّة" إلى الخليفة الرّاشد الثاني: نظرات في مواقف العلماء المعاصرين <br>On the Attribution of "'Umar Terms" to Second Rightly-guided Caliph: Reflections on the Views of Contemporary Scholars JF - At-Tajdid - Intellectual Refereed Journal JA - At-Tajdid VL - 17 IS - 33 SE - Criticism and Viewpoints DO - 10.31436/attajdid.v17i33.15 UR - https://journals.iium.edu.my/at-tajdid/index.php/tajdid/article/view/15 SP - AB - <p align="right">لقد جرت العادة في الكتب الفقهية أن تصف غير المسلمين الذين عاشوا في ظل الخلافة الإسلاميّة بأنهم أهل الذِّمّة. وبعد زوال الخلافة الإسلاميّة، وتفرّق البلدان الإسلاميّة التي كانت تحت سلطتها إلى دول وطنية قطرية ذات نظم سياسية متباينة في توجهاتها وأشكالها مما لم يتعرض لأحكامه الأئمة المؤسسون للمذاهب الفقهية ولا أتباعهم الذين بنوا وفرعوا على أصولهم، أصبح استخدام هذا المصطلح محل نظر من قبل كثير من الباحثين مسلمين وغير مسلمين، نظرًا لما يثيره تطبيقه في العصر الحديث من إشكاليات نظرية وعملية. وفي سياق مناقشة موضوع أهل الذمة اشتهر بين العلماء والباحثين ما يسمّى بـ"الشروط العمرية"، وهي وثيقة منسوبة إلى الخليفة الراشد عمر بن الخطاب&nbsp; قيل إنه أصدرها من أجل إدارة شؤون أهل الذمة وتقييد حركتهم. وتحاول هذه الدراسة أن تلقي الضوءَ على تلك الشروط العمرية من خلال استعراض مواقف الفقهاء المعاصرين من صحتها سندًا ومتنًا، ومقارنة اجتهادات العلماء القدامى الذين اعتمدوا تلك الشروط في تقرير الأحكام الفقهية الخاصّة بأهل الذمة باجتهادات العلماء المعاصرين في قضايا "المواطنة" في العصر الحديث، سعيًا في ذلك إلى بيان ما هو راجحٌ منها حسبَ قوَّة الاستدلال في ضوء مقاصد الشريعة الإسلاميّة.</p><p>&nbsp;</p><p dir="RTL"><strong>الكلمات الأساسية </strong>: أهل الذمة، الشروط العمرية، مقاصد الشريعة، المواطنة.</p><p>&nbsp;</p><p align="center"><strong>___________________________________</strong></p><p>&nbsp;</p><p>It is customary in books of Islamic jurisprudence to describe non-Muslims who lived under the rule of the Islamic caliphate as <em>ahl al-dhimma. </em>After the abolition of the caliphate and the disintegration of the Muslim countries that were under its rule into separate nation-states with different political systems both in orientation and form, matters that had not been addressed by the founding imams of the juristic schools nor by their followers who elaborated their rules and built on them, the use of this term has become a matter of controversy among Muslim and non-Muslim students of Islamic thought due to the fact that its application in modern times raises problematic issues theoretically as well as practically. Moreover, in the context ofthe discussion of the subject of <em>ahl al-dhimma</em> scholars and researchers are well familiar with the so-called ‘ÑUmar terms’ (<em>al-shurut al-umariyya</em>), a document attributed to the second rightly-guided caliph ÑUmar Ibn al-KhaÏÏÉb who is said to have issued it in order to regulate the affairs of <em>ahl al-dhimma</em> people and control their movement. This article sheds light on these so-called 'Umar terms’ by reviewing the positions of contemporary scholars concerning their authenticity in terms of both provenance (<em>sanad</em>) and textual structure (<em>matn</em>). It also contrasts the views of classical jurists who based their legal pronouncements pertaining to <em>ahl al-dhimma </em>affairs on them with the views of contemporary scholars who theorize on the basis of citizenship (<em>muwatana</em>).
