@article{أرتاليم (Muntaha Artalim)_2016, title={فهم النصوص الشرعية واستنباط الأحكام بين مقاصد الشريعة والتأويلية الحديثة: دراسة تحليلية نقدية <br> The Understanding of Scriptural Texts and Derivation of Legal Injunctions between Maqasid al-Shari’ah and Modern Hermeneutics: A Critical Analysis Study}, volume={20}, url={https://journals.iium.edu.my/at-tajdid/index.php/tajdid/article/view/317}, DOI={10.31436/attajdid.v20i39 A.317}, abstractNote={<p dir="RTL" align="center"><strong>مستخلص البحث</strong><strong></strong></p><p dir="RTL">فهم النصوص الشرعية وتأويلها من أهم القضايا في عملية استنباط الأحكام، بل تعدّ طرائق الاستنباط ربع مباحث علم الأصول. ولذلك خصها الأصوليون بجهود كبيرة من التأصيل والتفصيل والتقعيد المنهجي، لما لها من أثر كبير في إدارك مراد الشارع والكشف عن مقاصد الشريعة مما اشتملت عليه من الأحكام. وقد تعرضت المنهجية التفسيرية والاستنباطية التي جرى تطويرها وبناؤها في إطار علم أصول الفقه في الآونة الأخيرة لغير قليل من التهوين من شأنها والقدح في كفايتها العلمية من قبل فئات من دعاة الحداثة والتحديث الذين سعوا إلىى أن تُستبدل بها نظرياتُ التفسير والتأويليةُ أو "الهرمنيوطيقا" الحديثة في فهم النصوص التأسيسية للإسلام (القرآن والسنة النبوية) وإخضاعها لذات النهج من النقد التاريخي الذي انتهج مع نصوص التوراة والإنجيل. وقد فتح ذلك بابًا واسعًا للتلاعب بالنصوص ليس فقط بالتعسف في تفسيرها والتحريف لمعانيها، بل كذلك بإفراغها من أي مضمون ثابت خاص بها، وذلك بدعوى أن الألفاظ والخطاب والنص في المفهوم الهرميونيطيقي الفلسفي دلالاتها ليست فقط غير محصورة أو منضبطة، وإنما هي في تحول دائم وتبدل مستمر حسب الأحوال والأوضاع وحسب القارئ نفسه الذي هو في الحقيقة من يحدد مضمون النص ومعناه لا مؤلفه الذي أنشأه، إذ لم يعد لصاحب النص من حضور في تحديد محتواه، بل لقد مات المؤلف نفسه وأصبح النص ملكًا للقارئ يتصرف فيه كيف يشاء. وبذلك تهيأ لأصحاب هذه الوجهة أن ينفوا وجود أي ثوابت أو قطعيات أو يقينيات في الدين، وجعلوا معانيَ النصوص الشرعية ودلالاتها تجري وفق ميول القارئ ورغباته. وهذا البحث مداخلة نقدية أصولية مع بعض مقولات التأويلية الفلسفية في سياق تطبيقها من بعض دعاتها على النصوص الشرعية الإسلامية.</p><p dir="RTL"> <strong>الكلمات المفتاحية</strong>: فهم النص، علم أصول الفقه، مقاصد الشريعة، التأويلية (الهرمنيوطيقا)، موت المؤلف، سلطة القارئ.</p><p> </p><p align="center"><strong>Abstract</strong></p><p>The explication and understanding of Scriptural texts is among the important issues in the derivation and inference of legal rules. Indeed, the methods of legal inference constitute a quarter of the subjects of Islamic legal theory, <em>usul al-fiqh</em>. Considering their crucial role in comprehending the Lawgiver’s intent and discovering the SharÊÑah goals (<em>Maqasid al-Shari’ah</em>) in its commands, Muslim legal theorists devoted a great deal of effort in grounding, formulating and detailing those methods. However, the methodology of interpretation and legal inference developed by the scholars of <em>usul</em> <em>al-fiqh</em> has recently come under attack by groups of proponents of modernism and modernization who strive to replace by modern theories of explication and hermeneutics for the understanding of the foundational texts of Islam (the Qur’an and Prophetic Tradition) by subjecting them to historical criticism in the same vein as the Old and New Testaments. In like manner, a door wide open has been made available not only for manipulating the texts by abusing their interpretation and distorting their meaning, but also emptying them altogether of any fixed content that is specific to them. All this is done under the pretext that the denotations of words, discourse and text are not only unlimited or irregular, but they are also in constant alteration and continuous change according to circumstances and conditions and according to the reader himself who is in actual fact the one who determines the content and meaning of the text, not his author who is already dead! Hence, the reader is the owner of the text and it is up to him to dispose of it as he likes. This has made it possible for the proponents of this approach to deny the existence of any definitive meanings or certain truth in religion, and to make the meanings and connotations of Islamic Scriptural texts run in accordance with the reader’s inclinations and desires.
