What is the effect of modernization on the resilience of the nation and its intellectual and civilized witnessing of it? To complete the study, we need to adhere to the inductive analytical methodology where the modernization stages are induced and the implications for the real world are to be analyzed according to those stages from a civilizational perspective. Several results have been attained, among which is: Imam as-Shafii presented the science of the principles as a method of examination and explanation of jurisprudence and interpretation. His efforts in discovering this method as a form of knowledge show how he is a respectful leading scholar and deserves praise as well as the notability of being the pioneer. The study was then prolonged and completed by the scholars of the third and fourth centuries across the schools of thought and scientific methods to prove a wider horizon regarding the perfect comprehension of the mind as well as the heart of knowledge. In his book al-Mustasfa, he attempted to screen attempts for the science of principles, and despite his desire to steer clear of logical prologues and Aristotelian effects, he discovered that the weaning to what has been entrusted with is harsh! However, his writings on reviving the method of his teacher, Al-Juwaini, in his two books of al-Burhan and al-Ghiyathi are sufficient enough. Also, Imam As-Shatibi, in two of his books, al-Itisam and al-Muwafaqat, sketched features of induction and far from partial inference, such as a milestone in Islamic thought and civilization.
Keywords: Modernization - the principles of jurisprudence - civilized - effect
HASSAN Suleiman, Mahamed fathy Eletribi Copyright (c) 2022 Al-Risalah: Journal of Islamic Revealed Knowledge and Human Sciences (ARJIHS) Sun, 03 Jul 2022 00:00:00 +0800 منهج الشيخ محمد سيد طنطاوي في تفسير آيات الأحكام في كتابه التفسير الوسيط للقرآن الكريم
Abstract

The legislative objective is one of the most important purposes in the Holy Qur’an, and knowledge of it increases the faith of the taxpayer and his conviction in the legal rulings. Among the contemporary interpretations that took care of this aspect is the mediating interpretation of the Noble Qur’an by Sheikh Al-Tantawi, may God have mercy on him, whose author took care of the jurisprudential and legislative aspects, and was distinguished by the ease of expression, good presentation, and his combination of the maxim and reasonable interpretation. Recently introduced by contemporary scholars, in particular, the eminent Professor; Prof. Dr. Abullais Al-Khairabadi. The main problem in this topic is not to collect those hadith related to this topic, because that is the easy part. Any specialist in this field can find it in the books of hadiths their collections and their explanations. And the jurist (fuqaha’) and the fundamentalist (usuli) too, have compiled it in their book. Rather, the main problem lies in the issue of determining the correct and disciplined ways to know the extent to which the spatio-temporal dimensions are taken into account in the Prophetic text. And in achieving the extent of the strength of the link between The Hadith and real-life applications. So that we can then define its methodology to deal and work with. As it directly affects The Hadith of the Prophets, this research seeks to clarify the concept of temporal and spatial dimensions in hadith as well as in the history of its emergence and its applications in the Islamic scholarly thought. This research will be divided into two sections; the first topic will be concerning about defining the temporal and spatial dimensions in the hadith individually and simultaneously. And among the contemporary sharia scholars, such as Sheikh Nasir al-Din al-Albani, sees uncovering a woman’s face, and he repeatedly emphasized that the legal/sharia veil does not include covering the face in any way. In fact, the niqab is obligatory from the view of some Salafi extremists and fundamentalist. But the big problem is that in my country Afghanistan some people claim that the niqab is a political matter, not a religious one, and they do not believe in wearing it.

From my point of view, the niqab is one of the sharia needful (hajiyah) and ameliorative (tahsiniyah) interests, and it varies according to society and its circumstances, sometimes it is necessary and mandatory, and at other times it is optional and not necessary. If there is fear of sedition and harm, then it is an obligatory issue and become one of the necessary issue, as ti is the opinion of the Shafi’i and the Hanbalis Otherwise, it is desirable and among the ameliorative and decorative interests, as it is the opinion of the Hanafis and the Malikis.
Abdulfatah danishfar Copyright (c) 2022 Al-Risalah: Journal of Islamic Revealed Knowledge and Human Sciences (ARJIHS) Sun, 03 Jul 2022 00:00:00 +0800 مقاصد الشريعة الإسلامية وأهميتها في الحدّ من النزاعات الأسرية في تفعيل التحكيم
The objectives of Islamic law and its importance in reducing family disputes in activating arbitration. As this phenomenon is one of the major problems that the Afghan people suffer from, it has negative and dangerous effects on the individual, family and society levels. Among its most prominent effects are the emergence of extremism and ignorance, poverty and beggary, and the incidence of physical and mental diseases. The Noble Quran and the Sunnah of the Prophet drew the optimal approach to solving the phenomenon of unemployment, as it imposed zakat, urged charity, permitted good loans, and explained the role of reviving dead land and urging work and lawful earning. The research employed the inductive approach in collecting legal texts from the Quran and Sunnah and from relevant sources and references. The research also adopted the analytical method by analyzing the results of the field study, which aimed to interview university professors and experts. The study sample was conducted in Afghanistan and included 173 participants (168 males and 5 females) and data were collected using a questionnaire and the results of the questionnaire were analyzed through the technique of calculating proportions (SPSS). The study concluded with a number of results, the most important of which are: There are main reasons for the rise in unemployment, as the paragraph that states (the rule of relations over the law) came in the first place with 81.6%. In second place came the paragraph that states (the presence of corruption) with 81%. It came in the last rank, which states (the presence of foreign workers) with 49.4%. In light of these results, the study recommended directing students to the correct and required specializations in the labor market. The study also recommended inviting training centers to find useful programs and distinguished qualifications in line with the needs of the labor market.
Abdul karim Wasimi Copyright (c) 2022 Al-Risalah: Journal of Islamic Revealed Knowledge and Human Sciences (ARJIHS) Sun, 03 Jul 2022 00:00:00 +0800 Editorial Dr. Kabuye Uthman Sulaiman Copyright (c) 2022 Al-Risalah: Journal of Islamic Revealed Knowledge and Human Sciences (ARJIHS) Sun, 03 Jul 2022 00:00:00 +0800 The Contributions of Islamic Social Financial Institutions in Realizing Sustainable Economic Recovery for the Muslim Communities in the Philippines
Following the trends of world economies in their quest for a holistic framework and model that may contain the worst crisis that the global community is currently facing, the present study aims to show that there is an urgency for the revival of Islamic financial institutions: zakat, waqf, sadaqah, halal industry, and Islamic microfinance at the midst of a capitalistic system of economy. The purpose of the study is to re-discover the potential roles of Islamic financial institutions in securing a sustainable economic recovery that may uplift the socio-cultural and economic conditions of the Muslim communities in the Philippines. In addition, the study seeks to clarify that the economic label that describes the dormancy of Islamic social financial institutions does not stem from its sources, but rather, due to lack of recognition on the part of the government policymakers. Information on the teachers’ educational background in teaching and training was gathered, their perceptions of the problems they face in facilitating the teaching and learning process of the children, as well as their suggestions on effectively overcoming the setbacks. In-depth online interviews were carried out and data analysis was carried out by utilising Atlas-ti. The results indicated that the teachers face a lack of skills in teaching English because they are not English majors but rather graduates of early childhood learning. This can however be rectified if continuous training and development are offered for them especially when there is a change in the syllabus. Apart from the teachers’ initiatives in tackling the various problems like inadequate materials and books for teaching, recommendations were made to help improve the situation including ideas to have both parents and school administrators join forces in improving the quality of teaching. Teacher training needs to be further improved to ensure the effectiveness of the implementation of English as one of the instructional languages used in preschools. Inadequate resources and materials to be used in classrooms and also students’ low level of proficiency in English are some are the challenges faced by the teachers as well. Although technology is integrated into school, optimizing it in class can sometimes be a difficult task for the teachers due to software issues.
Ainul Azmin Md Zamin, Maskanah Mohammad Lotfie, Rabiah Tul Adawiyah Mohamed Salleh Copyright (c) 2022 Al-Risalah: Journal of Islamic Revealed Knowledge and Human Sciences (ARJIHS) Sun, 03 Jul 2022 00:00:00 +0800
