This, in fact, is the primary purpose of <em>Maqāṣid al-Sharīʿah</em>. To achieve this goal, it is necessary to promote human well-being. The main purpose of this study is to exermine the role of <em>Maqāṣid al-Sharīʿah</em> in the protection and development of human intellect among secondary school students in Nasarawa State towards moral, scientific, and spiritual attainments. The study utilizes descriptive design that allows exposition of the elements for the preservation of human intellect from all forms of evil to the development of a scientific mind in the secondary school students of Nasarawa State. The study reveals that five fundamentally universal objectives namely, religion, life, intellect, lineage, and property are parts of the ultimate objectives of Islam which are to serve human interests and save them from harm. The principles of <em>Maqāṣid al-Sharīʿah</em> can be applied to protect as well as develop secondary school student’s intellect. Intent of Sharia is to provide these rights to all followers irrespective of their gender, marital, social or economic status. From marital point of view, the widow and divorced woman has right of second marriage, either with a married man or unmarried. Similarly, a man has a right to have four wives at a time and this system is known as polygamy. This paper, in this context, explores the wisdom behind polygamy in the light of <em>Maqāsīd Al-Sharī‘a.</em> It tries to answer these questions: Is the law of polygamy allowed to fulfil one’s sexual desires legally? Secondly: what are the implication of polygamy in the preservation of family/ human race and nipping the social evils like prostitution, suicidal intentions, and mental issues? Mercy is what Allah ﷻ uses in the Qurʾān to describe His beloved messenger ﷺ.&nbsp; He ﷻ states: ﴿وَمَآ أَرْسَلْنَـٰكَ إِلَّا رَحْمَةًۭ لِّلْعَـٰلَمِينَ۞﴾We have sent you ˹O Prophet˺ only as a mercy for the whole world.<a href="#_ftn1" name="_ftnref1">[1]</a> Throughout his blessed life, the noble Prophet ﷺ embodied compassion in every way possible and spread it to every person, animal, place, and object that he met. Those who opposed him were not excluded from experiencing his mercy and even those who did not interact with him were either recipients of his compassion or benefactors of his mercy in some manner, whether directly or indirectly. We are living through turbulent times in our world today and humanity is in much need of compassion. There is clearly a shortage of mercy in the lives of many individuals and societies. Violence, war, corruption, injustice, social and political discord, and other kinds of unrest are all too common everywhere we look. For this reason, it is imperative that people of all walks of life, study the prophetic embodiment of mercy and compassion. The researchers will use the inductive method in order to collect the texts spread out in various old and contemporary books related to the subject, and then the analytical method to extract the most important issues related to mercy. The results of the research: When examining the life of the prophet of mercy, it is effortless to understand the ways in which he brought harmony between people of different views and backgrounds. This work is primarily inspired by Urdu and English commentaries written in 20th century. Although it is considered an elaborate work on <em>tafsīr</em>, no research has so far been conducted to explore its methodological pattern or to provide a critical analysis of this commentary. This study aims at dissecting the structure and analyzing the general methodological pattern of this commentary. More specifically, current study provides a comprehensive introduction of Syed Anwer Ali and his literary contributions, a brief introduction of his Qur’ānic commentary, the basic features and methodological analysis of this commentary. The methodological analysis reveals that Syed Anwer has not solely relied on the conventional method of <em>tafīsr</em> but he used a hybridized approach by aggregating conventional and modern methods. The study trailed the inductive method by observing the Qur’anic verses connected to the Worldwide Qur’anic Discourse to divulge the issues related within it; and the importance of these matters, by following appropriate supervision and reference from the scholars of Tafsir which proposes Holy Qur’an that related to it; in order to accomplish its full consequence and reimbursements. As well as the analytical method to deduce the universality of the discourse used, its significance and the disclosure of its contemporary fields. The study concluded that the most important is, highlighting the importance of properly understanding the Qur’anic discourse and its universality. One of the reasons for the weakness in the concept of the Universal Qur’anic Discourse among people in general is, people unable to identify and distinguish the exactitude in the Qur’anic discourse and its universality according to real, scientific, and practical applications. Its divinity, justice, infallibility, solidity, humanity, everlasting, definitive, comprehensiveness, and balancing, all of are meant for universal and does not subject to a specific hierarchy. The study focused to broaden the meaning and purposes of the Qur’anic discourse, especially when dealing with the great and vast human knowledge. Curriculum of Quranic education in the Egyptian Quran schools (Al-Katateb) and the Sudanese Quran schools (Khalawi). <p>يهدف البحث إلى التعريف بالكُتَّاب، والخلوة، والوقوف على المنهج التعليمي والتربوي فيهما، وأهميتهما في المحافظة علـى القرآن الكريم، ولغته العربية، ودورهما في دعم الأهداف التربوية للمرحلة التعليمية الأولى من حياة الطفل؛ بغية تمكين المتعلمين من اكتساب المهارات اللغوية المستهدفة، مثل: السماع، والقراءة، والكتابة، والحفظ. وتبرز أهمية البحث في بيان المنهج التعليمي والتربوي لمؤسسة "الكُتَّاب" و "الخلوة"، ودور هذا المنهج في المحافظة على مقومات الأمة الإسلامية، وحفظ تراثها المتمثل في القرآن الكريم، والسُّنَة النبوية، والعقيدة الإسلامية، واللغة العربية، وتاريخها الخالد. وتكمن مشكلة البحث في وجود تباين بين مناهج وطرق التعليم القرآني في دول العالم الإسلامي، وغياب التنسيق العلمي والتربوي بين المؤسسات المعنية بهذا الأمر، مما يترتب عليه ضياع الفائدة من تبادل الخبرات في هذا المجال المهم، والاستمرارية على ما هي عليه من وضع قائم لا يتلاءم مع الواقع، وعدم الطموح في التطوير الذي يتناسب وروح العصر الحاضر، الأمر الذي يؤدي إلى بذل الجهود الكبيرة مع تحصيل القليل من الفائدة المرجُوَّة. وكذلك الغياب الواضح للدور الرائد لهاتين المؤسستين عن الواقع المعيش، والأثر السلبي المترتب عليه. وقد اعتمد البحث المنهج التاريخي، والمنهج الوصفي التحليلي في تتبع ظاهرة الكتاتيب والخلاوي تاريخيًّا، ووصفها، وتحليل الآثار المترتبة عليها. ومن أهم نتائج البحث وجوب العمل على إحياء دور هاتين المؤسستين، وتطوير منهجيهما التعليمي بما يتناسب ومتطلبات الوقت الراهن؛ لمواجهة التحديات المعاصرة؛ حفاظًا على هُوية الناشئة المسلمة.</p> <p>The research aims at introducing the Kutab (Egyptian Quran school), Khelwa (Sudanese Quran school), and explaining the educational and pedagogical curriculum in them, their importance in preserving the Holy Qur’an, its Arabic language, and their role in supporting the educational goals of the first educational stage of a child's life. It also sheds the light on their role in enabling learners to acquire targeted language skills, such as listening, reading, writing, and memorization. The importance of research exists in the clarification of the educational and pedagogical curriculum of the “Al-Kuttab” and “Khelwa”, and the role of this approach in preserving the components of the Islamic nation and preserving its heritage represented in the Holy Quran, the Sunnah of the Prophet, the Islamic faith, the Arabic language, and its eternal history. The research problem lies in the existence of a discrepancy between the curricula and methods of Qur’anic education in the countries of the Islamic world, and the absence of scientific and educational coordination between the institutions concerned with this matter, which results in the loss of the benefit from the exchange of experiences in this important field, and the continuity of what it is of an existing situation that is not compatible with reality and lack of ambition to develop that is compatible with the spirit of the present age, which leads to making great efforts compared to gaining little of the desired benefit. As well as the apparent absence of the pioneering role of these two institutions from the living reality, and its negative impact. The research adopted the historical approach and the descriptive and analytical method in tracing the phenomenon of the Al-Katateb and al-Khalawi historically, describing it, and analyzing its implications. Among the most important results of the research is the necessity of working to revive the role of these two institutions, and to develop their educational methodology in line with the requirements of the present era. He spent his whole life contributing towards Knowledge and <em>Sunnah</em>. He lived a long life and gave nearly sixty years to teaching Sunnah with his full attention and eagerness. He graduated thousands of students who after him followed his path, they were the best of successors to a noble Scholar. We choose to present in this research some among them, prominent in the field of teaching, in order to inform the reader of their impact; and they are, the famous <em>Ḥadith</em> Scholar Shams al- Haqq Azeem Abādī (1273-1329 AH); the Sheikh of Punjab, The Muḥaddith Ḥafiz b. Abdul Mannān al-Wazeer Abādī (1267-1334 AH); the great Scholar and Muḥaddith al-Hafiz Muḥammad Abdullah al-Ghazipurī (1261-1337 AH); The Scholar Abdul Salām al-Mubārakpurī (d.1342 AH); The Muḥaddith Abdul Reḥmān al-Mubārakpurī (d.1353 AH) author of ‘<em>Tuḥfah al-Aḥwaz</em>ī’ and the Scholar Abu Qāsim Saif al-Banārasī (d.1369 AH).</p> نذير أحمد عبد الواحد Nazeer Ahmed Abdul Wahid, محمد أبو الليث الخيرآبادي Mohamed Mohammed Abullais Al-Khair Copyright (c) 2021 Mon, 30 Aug 2021 00:00:00 +0800 سلطة القاضي في التفريق والفسخ بين الزوجين The power of the judge to separate and annul the spouses <p>عقد الزواج هو الرباط المقدس الذي يجمع الرجل بالمرأة في الإسلام، وهو الذي يضفي الشرعية على العلاقة الزوجية ويمنحها الغطاء القانوني والشرعي، والحقوقي، ومن أجل أن تستقر الحياة الزوجية، وتحقق مقاصدها وأغراضها، لا بد أن تبنى هذه العلاقة على أساس الوضوح والقبول المتبادل بين الطرفين. فإذا كان أحد الطرفين به عيب بدني أو عقلي، ولم يكن الآخر مطلعاً عليه وراضياً به، ففي ذلك انعدام الرضا والقبول من جانبه، وتفويت مصالحه وأغراضه من الزواج. لذا أعطى الإسلام حق فسخ عقد الزواج لكل من الطرفين إذا اكتشف بعد العقد وجود مثل ذلك العيب أو الخلل، وجعل له أحكاماً وشروطاً لا بد من توفرها فيه. من هنا تأتي أهمية موضوع البحث، فإنهاء العلاقة بين الزوجين ليس على حال واحد، بل يختلف باختلاف السبب المؤدي إليها، وهذا ما سنتناوله في بحثنا هذا، بالإضافة إلى أمور أخرى متعلقة بالفسخ.</p> <p>In Islam, marriage contract is a sacred link that brings man and woman together. It gives the marital relation its legal cover. So, for this relation to be stable and fulfill its objectives, it should be established based on clarity and mutual consent between the two parties. Thus, if a party suffers a physical or mental defect of which the other party is not aware of and did not indicate acceptance of, this implies that there is no consent toward the defected party. The other party may lose his/her interest or purpose of the marriage. Hence, Islam grants the right of dissolving the marriage contract to both parties in case it was learned, after the marriage is solemnized, that a partner suffers a defect. Islam also set rules and terms for such dissolution to happen. Without her, the movement of life inside and outside the family is unsettled. The divine regulations have given women a wonderful arrangement of consideration, which was demonstrated in the acknowledgment of many proclamations related to their issues. However, her view of the woman's position in her household, and how to preserve her, varies; Consequently, this study originates to elucidate the fact of assessment of both Islam and Christianity about the position of women in family life, and means of protective them in the light of texts from the noble Prophetic hadiths comparing it with texts from Christianity; To illuminate some of the resemblances and variances between them, and it turns out that the Islamic Sharia is the one who gave the woman the long-term position, and cultivated her with the most comprehensive care. The research aims to understand the reality of the problem of the noble hadith, which is every authentic hadith whose meaning is hidden, or ambiguous with something else, or an impossible illusion, or a conflict, and then clarifying the scientific rules related to it.</p> <p>The researcher used the inductive and analytical method, and the research concluded with results, the most important of which are: the impossibility of a conflict or a real problem between two authentic texts, And that Imam al- Ṭahāwī paid great attention to refuting the confusion from the noble hadith in his book Sharh Mushkil al-Athār, and the majority agreed with the methods of repelling the problem, except in a few things that agreed with the Hanafis and disagreed with the majority. He was unique in combining the texts with the union of the place, and in deciding that the transcription from mitigation to strictness takes place at the time of punishment and from strictness to mitigation in other than that.</p> Mona Salama Ayesh AL-aroui منى سلامة عايش العروي, حسام موسى محمد شوشه HOSSAM MOUSSA MOHAMED SHOUSHA Copyright (c) 2021 Mon, 30 Aug 2021 00:00:00 +0800 جهود المحدث نذير حسين الدهلوي في خدمة السنة النبوية وما كان يتميز به The Efforts of the Muhaddith Nazeer Husain Al-Dehalwi in Serving the Prophetic Sunnah and What Distinguished him <p>إن أرض الهند يحق لها أن تفتخر بجهود أئمة الحديث في القرن الثالث عشر الهجري الذين نشروا راية السنة في ديار الهند تعليما وتأليفا وشرحا وعملا ودعوة، وعلى رأسهم الإمام المحدث الجليل السيد نذير حسين الدهلوي (1225-1320ه)، أمضى حياته في التدريس والإفادة من غير كلل ولا ملل، وقصده طلبة الحديث من كل أنحاء شبة القارة الهندية بل من خارجها من العرب وأفغانستان وتركمانستان والمغرب وأقطار أخرى، وكثرت تلامذته جدا حتى كانوا ألوفا مؤلفة، وكان من آثاره الحسنة إحياء السنة علما وعملا ودعوة، وقد آتاه الله ما تميز به على أقرانه ومعاصريه من اطلاعه الواسع في الكتب وحفظه واستحضاره وتحقيقه في المسائل ودعوته إلى تطبيق السنة من غير تقليد، كما تميزت دروسه بالتقرير البليغ، والقدرة على التفهيم، وسعة الأفق، وصبره وإخلاصه في التدريس. وقد شهد العلماء في زمانه وبعده بجهوده العظيمة في خدمة السنة النبوية فهو إمام السنة في القرن الثالث عشر في الهند حقا.</p> <p>The Indian land has rights in priding for efforts of Scholars of <em>Ḥadīth</em> of 13<sup>th</sup> century AH, who spread Sunnah in India; by educating, authoring, explaining, acting, and advocating people on it. A Scholar who presided with others is Imām Nazeer Ḥusain al-Dehlawī (1225 – 1320 AH). He spent his life teaching and guiding without any weariness or boredom, intending students not only from India, but from outside; from Arabia, Afghanistan, Turkmenistan, Morocco, and others, having students in thousands. His traces lie in reviving the knowledge, practice, and <em>Dawah</em> of <em>Sunnah</em>. He was distinguished through extensive knowledge, extraordinary memory, and knowledge evocation, he pursued the deep investigation and called for the practice of Sunnah without blind imitation, he stood tall for eloquence, understandability, broad-mindedness, patience, and sincerity. Scholars of his time and afterward, stand witness to his efforts in serving and reviving the <em>Sunnah</em>. Many problems concern their degree of comprehension, as previous scholars discussed many variables that led to their perceptions. The beginning of the halal logo is one of the substantial parts of efforts to influence customer consideration while building their feelings of confidence towards purchase selection, making it important to discover. This qualitative research aims to illustrate a finding focused on customer views on halal-related issues. An in-depth interview session explained it analytically from the viewpoint of experts. Based on the discussion among eight halal experts in this region, the finding reveals six major concerns shown as an essential part of the study and were issues of "fake" logo, COC, religion, ingredients, lack of knowledge and Islamic clues. Since the advent of democratic rule in 1999, the heterogeneous nature of the Nasarawa State in terms of religion and ethnicity has created a major challenge of diversity management as evident in the prolonged inter-communal, religious, and ethnic related conflicts that plagued the zone with grave humanitarian consequences. Deaths associated with these conflicts are unevenly distributed in terms of their frequency and intensity. Key drivers of these conflicts have been contestations over access to land control of political and economic power, as well as disputes over indigeneship, which reflects a conceptual difference enshrined in Nigeria’s constitution.
